These Terms of Service (“Terms”) govern your access to and use of the website located at https://geumbull.com/ (the “Site”), operated by Cbahu LLC (“Geumbull,” “we,” “us,” or “our”). These Terms apply to all visitors, users, and others who access or use the Site and purchase apparel and related products (“Products”) offered through the Site.
By accessing or using our Site, creating an account, or purchasing Products, you signify that you have read, understood, and agree to be bound by these Terms and our integrated policies, including our Privacy Policy, Shipping Policy, and Refund & Return Policy. These policies are incorporated by reference into these Terms. If you do not agree to these Terms or any incorporated policy, you must not access or use the Site or purchase our Products.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Certain features or services offered on or through the Site may require you to open an account. You must provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. You agree to notify Geumbull immediately of any unauthorized use of your account or password, or any other breach of security.
4. Product Information, Availability, and Made-to-Order Process
We endeavor to provide accurate descriptions, images, pricing, and availability information for Products listed on the Site. However, we do not warrant that product descriptions, colors, availability, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free.

Made-to-Order Nature: Please be aware that Geumbull Products are designed in-house and typically made to order through our trusted production partners after your order is confirmed. This allows us to offer unique designs and maintain quality standards efficiently. Production lead times associated with this process are outlined in our Shipping Policy.

Availability: All Products are subject to availability, and we reserve the right to limit the quantity of Products we supply, supply only part of an order, or divide up orders. We also reserve the right to alter the terms or duration of any special offers or promotions.

Pricing Errors: Despite our best efforts, a small number of items on our Site may be mispriced. If a Product’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you an order confirmation or a shipping confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mispricing.
5. Orders, Payment, and Acceptance
By placing an order on the Site, you are offering to purchase a Product subject to these Terms. All orders are subject to availability and confirmation of the order price.

Payment: You represent and warrant that if you are purchasing something from us, (i) any payment information you supply is true, correct, and complete, (ii) charges incurred by you will be honored by your payment method company, and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes and shipping charges.

Order Processing: We use third-party services for payment processing. We will not store or collect your full payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy.

Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Geumbull reserves the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether or not your payment method has been charged. If your payment method has already been charged and your order is canceled, we will issue a credit to your payment method account. Acceptance of your order will be complete upon shipment of the Product(s) ordered or upon sending you an explicit email confirmation accepting the order.
6. Shipping Policy
All purchases from Geumbull are subject to our Shipping Policy, available at Shipping Policy Page. This policy details important information regarding production times (due to our made-to-order process), shipping methods (including our use of reputable carriers like USPS, UPS, DHL, depending on destination), estimated delivery timeframes, shipping costs (if applicable), and tracking information. Please review it carefully. Risk of loss and title for items purchased pass to you upon our delivery of the items to the carrier.
7. Refund and Return Policy

The Geumbull name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cbahu LLC or its affiliates or licensors. You must not use such marks without the prior written permission of Geumbull. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.
9. Prohibited Uses
You may use the Site only for lawful purposes and in accordanceance with these Terms. You agree not to use the Site:

You expressly agree that your use of, or inability to use, the site and the products is at your sole risk. We do not warrant that the results that may be obtained from the use of the site will be accurate or reliable. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.

11. Limitation of Liability
In no case shall Geumbull, Cbahu LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the site or any products procured using the site, or for any other claim related in any way to your use of the site or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the site or any content (or product) posted, transmitted, or otherwise made available via the site, even if advised of their possibility.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. Notwithstanding the foregoing, our total aggregate liability to you for any and all claims arising out of or relating to these terms or your use of the site or purchase of products shall not exceed the greater of (a) the amount paid by you for the product(s) giving rise to the claim, or (b) one hundred U.S. Dollars ($100.00).
12. Indemnification
You agree to indemnify, defend, and hold harmless Geumbull, Cbahu LLC, and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
13. Governing Law and Jurisdiction
All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Montana, United States, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Montana, in each case located in the City of Billings and County of Yellowstone. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
15. Entire Agreement
These Terms and our Privacy Policy, Shipping Policy, and Refund & Return Policy constitute the sole and entire agreement between you and Geumbull (Cbahu LLC) regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
